    • Man I can't believe I'm actually finally seeing this for the Islanders after watching pretty much every single team in the NHL get a new rink before us. Late 80's the Coli was starting to break down. Calgary got a brand new shiny arena. Now Calgary is about to get a new one right behind us because now the Saddledome is old. It is crazy to think what us Isles fans have been through for the last 35 years.

      We so FINALLY deserve this!

            Yup, here it comes.

Village of Floral Park filed papers in court to try to stop work on the Islanders' Belmont arena project. Stay at http://Newsday.com for more updates.

Longobardi said the meeting Monday with state budget director and project developers is still on. "We decided we should do everything we think necessary to protect the village," he told Newsday Tuesday. "We will be at the meeting and hope it's productive."

"This lawsuit concerns a project proposed to be developed for private use on a portion of Belmont Park that is, by any objective standard, completely at odds---in terms of purpose, proportionality and compatibility---with the suburban communities that surround it."

The basis of the lawsuit is this ---> Floral Park believes that plans they uncovered (via a FOIL) that show NYRA had drawn up plans for an Isles arena at Belmont before any RFP raise questions about the legitimacy of ESD's subsequent public bidding process for Belmont land.

There are three defendants: -Empire State Development -Franchise Oversight Board (which owned the land at Belmont until just recently) -New York Arena Partners
Let's hope every t is crossed and every i is dotted, and this goes away quickly.

'Yesterday, September 9th, the Village of Floral Park commenced an Article 78 Proceeding in the Supreme Court of the State New York, Nassau County seeking judicial review of the approval by Empire State Development Corporation (ESD) of the Belmont Park Re-Development Project (the “Project”).

The Village was compelled to take this step because ESD failed to address the concerns of our residents and failed to mitigate the very real negative consequences to our Village that will result from the massive size and scope of the Project, which includes a shopping mall, a hotel and a sports and entertainment arena.

However, the good faith extended by the Village was not returned by ESD and NYAP. Despite near unanimous public opinion that the size and scope of the Project needed to be scaled back if the Project were to be workable, ESD and NYAP drastically increased the size and impact of the Project. Meanwhile, our residents’ concerns about increased traffic and the impact on our residential areas were virtually ignored...'

Near unanimous public opinion? Seriously? Maybe on 2 blocks in Floral Park. But not in general.

I am hoping this gets laughed out of court. I have to assume that Cuomo and NYAP are ready for this. At least I hope so.

I think FP saying 'ESD and NYAP drastically increased the size and impact of the project' may imply the new Elmont LIRR, which allegedly abuts a Floral Park elementary school.

More details in next version going up soon, such as this: Longobardi confirms Floral Park has $50,000 left in legal budget for year, and he has said a suit would likely cost more. But, he says, "the village has other resources if necessary." Won't elaborate "for obvious reasons."

                      • Like I said, they know this is a losing cause, so they aren't going to rack up a ton of legal costs to move forward. This is a losing battle and as you suggested Mark, they want something in return.

I am curious to see if Cuomo throws them a bone or tells them to kiss off.

well my cousins live in Floral Park and don't watch hockey but they do not oppose the project... so I guess it's not really unanimous. :-)

The Article 78 lawsuit filed in State Supreme Court claims that Empire State Development failed to address the concerns of Floral Park residents and failed to mitigate the “very real negative consequences” to the village resulting from the “massive size and scope” of the $1.3 billion project, according to a statement from Floral Park Mayor Dominick Longobardi. The court action is seeking new environmental impact studies on the redevelopment.

The 100-page lawsuit also seeks a halt to any further construction at the site “until the appropriate environmental review has been completed.”...

Our police force and emergency services will be overburdened trying to deal with the extra traffic,” Longobardi told LIBN late last year. “We’re not against the Islanders. We just think the development is too large for the site and they should rethink the size of the project and its impact on the quality of life for our residents and our neighbors in surrounding communities.”...

The village’s lawsuit was filed by its attorneys at Manhattan-based law firm Beveridge & Diamond. Defendants include ESD, the state’s Franchise Oversight Board and New York Arena Partners.'

Won't say how I know this but there could be a substantial delay but not because of litigation brought on by Floral Park but there are challenges with getting utilities, namely PSEG, to the site. There may be the need for further permitting. Don't want anyone to see this possible delay as a smoke screen.
